Probate and Estate Litigation

Augusta, Georgia, Probate and Wills Attorney

When a loved one dies, a family member must address the deceased's debts and then transfer his/her assets to the next generation. If a person has made a Will, that document says what he/she wishes done with the worldly belongings. If a person dies without a Will, then the Estate must be administered according to a plan established by the State of Georgia. If a person dies with a Will, he/she designates an Executor to carry out his/her last wishes. If a person dies without a Will, then the family must select a person (the Administrator) to administer the deceased person's Estate. There are many decisions to be made.

We have experience in assisting our clients with the following matters:

  • Preparing a Last Will and Testament
  • Probating a Last Will and Testament: Presenting the Will to the Probate Court for Judicial Recognition
  • Administering the Estate: Inventorying the Estate, paying debts, and then distributing the assets according to the terms of the Will or the law of the State of Georgia
  • Preparing the Deeds and documents necessary to transfer the assets from the deceased to his/her beneficiaries
  • Will Contests: Sometimes a family member will contest a deceased's Will. Generally, the person feels that he/she should have received more under the Will than the deceased left them. We have experience in Will contests in both challenging and defending Wills.

Guardianship and Conservatorship

A Guardian is a person appointed by the Probate Court Judge to be responsible for the person of a child or an incapacitated adult. A Conservator is a person appointed by the Probate Court Judge to take care of the property of a child or an incapacitated adult.

We have experience in advising clients on whether a Guardian or Conservator is appropriate, for assisting them to apply to be appointed as Guardian or Conservator and in assisting them to comply with the Probate Court rules regarding Guardianship and Conservatorship.

We also have experience in contested Guardianships and Conservatorships.

Probate cases occur in the context of family's loss over the deceased person. Our approach is to treat each client with respect and personal attention and we give each case the professional care it deserves.

As part of our commitment to customer service, we return phone calls promptly and offer weekend and evening meetings by appointment.

Please contact us today to schedule an appointment with an experienced Probate and Wills lawyer.
